Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley,

Duane Deterding, Willis Roethemeyer, Board Assistant, Tammy White and County Clerk, Rebecca

Rossell. Roethemeyer offered prayer. Chairman Hewgley called the meeting to order at 9:02 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review

and the county board will comply with the open meeting requirements.

Motion by Deterding, seconded by Roethemeyer to approve the minutes regarding the Lincoln County

Board of Commissioners meeting held on December 20, 2010. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the treasurer’s receipts.

Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to set the mileage reimbursement rate at 51 cents

per mile beginning 1-1-2011 as per the State of Nebraska Dept. of Administrative Services. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to receive and order filed the fee report submitted by

the County Sheriff. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,

none.

Motion by Roethemeyer, seconded by Deterding to reappoint Janelle Hawks as the spirited person

and Dr. David Lindley as the Medical Director for the West Central Health Department Board for 3

year terms. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Deputy County Attorney, Joe Wright, arrived at 9:15 A.M.

The Lincoln County Board of Commissioners recessed at 9:16 A.M. and the Lincoln County Board of

Equalization convened.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review

County Assessor, Mary Ann Long, appeared.

Motion by Roethemeyer, seconded by Deterding to approve the minutes regarding the Lincoln County

Board of Equalization meeting held on December 20, 2010. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to approve and authorize the chairman to sign the

certificates of correction and refund as submitted by the County Assessor. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to approve the motor vehicle tax exemption

application submitted by Maranatha Bible Camp and recommended for approval by the County

Treasurer. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Deterding to approve the motor vehicle tax exemption

application submitted by GPRMC and recommended for approval by the County Treasurer. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization adjourned at 9:21 A.M. and the Lincoln County Board of

Commissioners reconvened.

Motion by Deterding, seconded by Roethemeyer to set January 24, 2011 at 10:30 A.M. as a time to

receive bids for motor grader blades for the Lincoln County Dept. of Roads. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to approve and authorize the chairman to sign an

adoption agreement and amendments to the Cafeteria Plan, Medical Reimbursement Plan,

Dependent Care Assistance Plan and Health & Accident Insurance Premium Reimbursement Plan

with First Concord Benefits Group LLC due to the Health Reform Act. Upon roll call vote Deterding,

Roethemeyer and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Roethemeyer to approve and adopt Resolution No. 2011-01

designating the Lincoln County Sheriff’s Office as the animal control authority pursuant to Neb. Rev.

Statute 54-623.01. Upon roll call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays,

none.

Motion by Deterding, seconded by Roethemeyer to approve and adopt Resolution No. 2011-02 giving

and granting the chairman of the Lincoln County Board of Commissioners the authority to approve or

deny requests for family or medical leave of absence by employees in county departments. Upon roll

call vote Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Kirk Nichols (Construction Project Manager/Owners Representative) and Carol Rouw of Treanor

Architects (appearing by phone) gave a construction update of the Lincoln County Sheriff’s Office &

Detention Center.

Motion by Roethemeyer, seconded by Deterding to go into closed session at 10:15 A.M. to discuss a

personnel matter to prevent the needless injury to the reputation of an individual. Upon roll call vote

Deterding, Roethemeyer and Hewgley voted “aye”. Nays, none.

Chairman Hewgley restated the reason for the closed session.

Motion by Roethemeyer, seconded by Deterding to go into open session at 10:47 A.M. Upon roll call

vote Hewgley, Deterding and Roethemeyer voted “aye”. Nays, none.

The meeting was adjourned at 11:33 A.M.

Advance notice and the agenda for the January 3, 2011 board meetings were sent to members of the

county board, county attorney and all others requesting the same. Notice was posted at the Lincoln

County Courthouse, City Hall and on the county website.

The agenda for the meetings to be held on Monday, January 10, 2011 will be kept continually current

and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln

County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioner’s

Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be held at

the Lincoln County Courthouse in the Commissioner’s Room at 9:15 A.M.
