Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, County Clerk, Rebecca Rossell, Deputy County Attorney, Joe Wright and Board Assistant, Tammy White. Hewgley offered prayer. Chairman Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Roethemeyer, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on May 9, 2011. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to receive and order filed the fee reports submitted by the Register of Deeds and County Sheriff. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and adopt Resolution No. 2011-18 to transfer excess funds in the Road Bond Fund to the General Fund in this fiscal year and all future collections. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the chairman to sign the right of way permits submitted by Qwest and Electric Rain, Inc. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Hewgley, seconded by Roethemeyer to approve the minutes regarding the Lincoln County Board of Equalization meeting held on May 9, 2011. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

Motion by Roethemeyer, seconded by Hewgley to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:17 A.M. and the Lincoln County Board of Commissioners reconvened.

 

County Sheriff, Jerome Kramer, reported that he had been in contact with Justin Bilby concerning the special designated liquor permit for Rock N Horse Lounge for an event to be held here in Lincoln County. He had no issue with the application.

 

Motion by Hewgley, seconded by Roethemeyer to approve the special designated liquor application submitted by Rock N Horse Lounge of Bridgeport, NE for an event to be held at the Creekside Event Center on June 18, 2011. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Clerk of District Court, Deb McCarthy, asked Commissioners to consider adding approximately $900 to a budget line item in the next budget year to allow a Microfilm Imaging Systems software upgrade.

 

County Board directed her to submit this request in the 2011/2012 budget.

 

Clerk of District Court, Deb McCarthy, asked Commissioner to consider allowing 6 members of the Mental Health Board to attend in person training and would add approximately $1200 in the next budget year.

Commissioner Hewgley reported he had verified information contained in the two proposals received last week for providing an engineering study and construction estimate for an electrical, mechanical and plumbing replacement project in the Lincoln County Courthouse. Hewgley recommended ME Group for a total cost of $14,000.

 

Motion by Hewgley, seconded by Roethemeyer to accept the proposal of ME Group for a total amount of $14,000 which includes a presentation to the County Board. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Discussed the Administrative Settlement Report, entering The county of Lincoln into the following contract, and giving authority to the Chairman to sign the below documents, concerning the construction of a new viaduct in Lincoln County (Front Road Grade Separation), Project No. RRZ-1390(3), and State Control No. 61416.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the Chairman to sign an Administrative Settlement Report concerning real estate owned by Olson Farms, Inc. Offer being $19,440. The real estate is located in Section 26, Township 14 North, Range 32 West of the 6th P.M., in the County of Lincoln, Nebraska. Also

including that the county agrees to put a fence at the county’s cost of $921.20. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Roethemeyer to approve and authorize the chairman to sign a Partial Acquisition Contract with Olson Farms, Inc., purchasing certain real estate, owned by Olson Farms, Inc., for $19,440. The real estate is located in Section 26, Township 14 North, Range 32 West of the 6th P.M., in the County of Lincoln, Nebraska. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Motion by Roethemeyer, seconded by Hewgley to approve and adopt Resolution No. 2011-19 authorizing the Chairman to sign a Project Agreement between The county of Lincoln and the Nebraska Dept. of Roads to use federal and state funds to replace a bridge located at the East line of Section 28, Township 13 North, Range 29 West of the 6th P.M., Lincoln County, Nebraska, Structure No. C005636715, located over the Tri­County Canal. Upon roll call vote Hewgley, Roethemeyer and Deterding voted “aye”. Nays, none.

 

Construction update given by Kirk Nichols on the Lincoln County Sheriff’s Office and Detention Center.

 

Approved the following claims presented for payment: The meeting was adjourned at 11:14 A.M.

 

Advance notice and the agenda for the May 16, 2011 board meetings were sent to the county board, county attorney and all others requesting the same. Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on May 23, 2011 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be held at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be held at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
